Adventure Rabbi: Synagogue Without Walls Whitewater Rafting Program – Participant Release and Assumption of Risk (Colorado) Please read carefully. This is a legal agreement and a condition of participation. Third-Party Outfitter I understand that Adventure Rabbi: Synagogue Without Walls (“Adventure Rabbi”) is not a rafting outfitter, guide service, or water-activity provider. All whitewater rafting and river activities will be conducted by a separately licensed and insured Colorado rafting outfitter (the “Outfitter”), which will provide guides, safety instruction, equipment, transportation related to the rafting activity, and operational supervision. Adventure Rabbi’s role is limited to organizing the group experience and providing Jewish educational, spiritual, and community programming. Adventure Rabbi does not supervise, control, direct, or assume responsibility for the rafting activity, river operations, safety procedures, equipment, or decisions of the Outfitter. I understand that I will be required to sign a separate waiver and assumption of risk agreement provided by the Outfitter. Assumption of Risk I understand that whitewater rafting and outdoor activities involve inherent and significant risks, including but not limited to: Drowning, cold-water immersion, hypothermia Falling from rafts, capsizing, or collisions with rocks, equipment, or other participants Injuries including sprains, fractures, head, neck, or spinal injury Illness, allergic reactions, altitude or weather-related conditions Remote locations and delayed emergency response Loss or damage to personal property Serious injury, permanent disability, or death I voluntarily and knowingly assume all risks, known and unknown, inherent or otherwise, associated with my participation. I understand that I am responsible for my own safety, decisions, and conduct during the program. Release of Liability In consideration for being allowed to participate, I release, waive, and forever discharge Adventure Rabbi: Synagogue Without Walls and its directors, officers, board members, clergy, rabbis, teachers, employees, contractors, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, or liability arising out of or related to my participation in this program, including claims based on the negligence of the Released Parties, except where prohibited by Colorado law. This release includes, but is not limited to, claims arising from: Participation in group activities or events Transportation to or from program locations (whether arranged by me, Adventure Rabbi, or others) Activities conducted by the third-party Outfitter The acts, omissions, decisions, or services of any independent contractor or service provider Independent Contractors I understand that the Outfitter and any other service providers are independent contractors and not employees, partners, or agents of Adventure Rabbi. Adventure Rabbi is not responsible or liable for their acts, omissions, equipment, operations, safety practices, or decisions. Indemnification I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, or expenses (including attorney fees) brought by me, my family, heirs, or any third party arising from my participation. Health and Conduct I certify that I am physically and medically able to participate and will follow all safety instructions provided by the Outfitter and program leaders. I understand that participation may be denied or terminated if I am judged to be unsafe, impaired, or unprepared. Changes, Weather, and Refunds I understand that outdoor programs are subject to weather, river conditions, safety considerations, and operational decisions by the Outfitter or program leaders. Activities, schedules, or locations may be modified, delayed, or cancelled. Registration fees are non-refundable unless otherwise stated. Minors If signing for a minor, I certify that I am the parent or legal guardian and agree to this release, assumption of risk, and indemnification on the minor’s behalf. Media Release I grant Adventure Rabbi permission to use photographs or video taken during the program for educational or promotional purposes. Governing Law This agreement is governed by the laws of the State of Colorado and is intended to be as broad and inclusive as permitted by Colorado law. If any portion is held unenforceable, the remainder shall remain in full force and effect. Acknowledgment I have carefully read this agreement and understand that I am giving up substantial legal rights, including the right to sue Adventure Rabbi and its leadership. I sign this agreement voluntarily.
Refunds are not available unless the trip is canceled .
